Mislabeling: It's Far From a Victimless Crime.
*Everyone is well aware of the epic contractor vs. employee debate, who falls under what category - mislabeled or not- and which occupations SHOULD fall under one category or another, because it makes sense! That's where strippers are at right now.. Those who've woken up and realized they can have cake but if they wanna eat it too, they're going to have to change union laws set by the US Dept. Of Labor & Nat. Labor Relations Board. In other words, IF YOU DON'T WANT TO BE AN EMPLOYEE, DO WHATEVER YOU CAN TO MAKE YOUR CLUB OWNER GO LEGIT! Otherwise, keep putting your future in the hands of people who've never danced and aren't going to listen to you; even though they NEED TO!!
*Dancers ARE in a class all their own, meaning the job is incomparable to any other; though business patterns do mimic the service and hospitality industry, as the majority of clubs are also bars. BYOB clubs are in fact bars and DO require a liquor license to allow alcohol consumption on the premises. Some states, like IL have Vegas style clubs with full bars and kitchens, as many also serve food. Right next door in IA, absolutely NO hard liquor is to be consumed nor sold in nude establishments; and this was in part to make gentlemen's clubs lose business. It worked. It also brought down the QUALITY of customers.
*If you're mislabeled, then you're an employee who's been convinced they're a contractor; and ALL dancers on schedules know it's illegal. Yet, no one speaks up. I never knew why so many THANKED ME and said they admired my bravery. What bravery? Standing up for what's right? Telling everyone who WROTE laws that they suck at enforcing their own laws? I'm only telling the honest truth. A LOT of strippers get pissed off at me when I explain labor laws to them..
*Recently I was told some very rude things by a stripper who had no idea I'd worked with a major labor rights org. IN HER STATE and I still correspond with the director. They were put off by my colleague's approach and I was RELENTLESS in reeling the woman back in to actually HEAR her and now there's a law in said state that wouldn't exist if WE hadn't told this worker's rights group, people from a 2nd group & some recently fired DejaVu dancers OF THEIR RIGHTS!! I'm not saying I had ANYTHING to do with the law itself, but they came to us for a reason; and I sent them the Dancer Bill of Rights, which wouldn't you know, some of the laws are based on.
*Originally they'd reached out and spoke to 2 of us. They didn't like what my colleague had to say and it scared them off.. I had to use my dastardly skills to reel them all back in and tell them EVERYTHING, including actually answering their questions; and not repeatedly say the same thing, never hearing them out. The dancers in this state are contractors and they also proved everyone WRONG by successfully keeping laws in check, despite not being employees.. That's ALL to say, WTF IS WRONG WITH THIS PICTURE?!
*There are THOUSANDS of FLSA suits against clubs but they settle quickly and rarely see the light of day. Unless you put up a DejaVu style fight, you'll never have your story heard.. Here's the thing... WE ALL HAVE THE SAME STORY with MINOR variations. We're ALL sexually assaulted and FEAR BEING ARRESTED FOR SELF DEFENSE whilst our assailants walk free. The aforementioned state almost put a stop to that.. They should be proud. But if you really wanna be an asshole, get the attention of govt. agencies and get the general public on your side; then point out how they're all well aware of MANY problems and are NOT enforcing their own laws...
*You'd think the IRS would like ALL BACK TAXES from 3,840 shady ass establishments who USE our labor to not only illegally STEAL from us, but ALSO USE OUR SIGNATURES TO COMMIT 4 TYPES OF TAX FRAUD!!! Our signature on that FAKE contract and their masterful ways of cooking books make it appear that they have enough business to pay the mortgage on their million dollar homes! They get away with it for DECADES, get sued and STILL CONTINUE THEIR SHIT!! Well.. That's over.
*Since everyone is too afraid of their bosses (RED FLAG!!! CONUTRACTORS DON'T HAVE A BOSS, EXCEPT THEMSELVES!!) to step forward, I did. My news article hit the entire nation amd why? Because I EXPOSED THE TRUTH!! What do YOU call being scheduled for more than 40 hours a week, never allowed to leave unless you pay or just get fired, and giving 70% of your gross income to the club?! Modern day slave labor comes to mind but NONE OF THAT makes you a contractor. The attorneys you hire know it. Judges know it. CLUB OWNERS KNOW IT! YOU KNOW IT!!
*So DON'T be obvious about it. IRS form 3949-A is TO REPORT MISLABELING and most people check off the SAME 3 boxes when asked what their employer is guilty of? Failure to withhold and failure to report income are GURANTEED for mislabeled workers. Try IRS form SS-8.. It's long but it's for the IRS to DETERMINE WHAT YOU REALLY ARE!! All you have to do is send your last tax return in WITH the form.. Now, if your club is taking 70% of your income, you still OWE the IRS 30% of your GROSS income, so 30% of what you had BEFORE you were robbed. Yes.. That means giving them EVERYTHING you're left with, if you can do basic math..
*The IRS couldn't even tell me WTF I was WITH my tax returns!! You have GOT TO make sure your place of employment is legit, because THEY won't! IRS form 211, the whistleblower form.. So many narc forms to remain ANONYMOUS and yet, you'd much rather be miserable, complain and talk down to people helping you..
*For those who DO GET IT.. Employees have every right to complain to OSHA.. Especially if you're in a state where bars ARE allowed, or worse, kitchens! If they're not held up to code PER CDC STANDARDS ALL RESTAURANTS MUST MEET, they're doing something illegal! Club owners with nothing to hide don't have ANY issues with the health dept, which is federal, sniffing around. AUDITS SHOULDN'T BE A FEAR EITHER.. But those are the majority of club owners' BIGGEST FEARS!! Why? Because they KNOW THEY'RE EVADING TAXES, HIDING CASH, SHOULD BE QUARANTINED BY THE HEALTH DEPARTMENT AND let's not foget.. TRAFFICKING!!
*Clubs are notoriously conveyer belts for strippers. They know if business is slow, hiring 5 or 10 more dancers will fix that, because THEY NEVER WORK A DAY IN THEIR LIVES for what they have; WE DO IT FOR THEM!! Again.. That pesky signature on a FAUX CONTRACT is their ticket to keep being crooks whilst taking away all your rights.. TOO BAD SEXUAL ASSAULT AND LITERAL SEX OFFENDERS DO. NOT. GET. A. FREE. PASS. WITH. US!! In fact, you CAN legally report YOUR CLUB (anonymously if you're afraid) FOR ALLOWING ASSAULT AND ALLOWING SEXUAL PREDATORS TO NOT ONLY WALK FREE, BUT GET A FREE PASS IF THE CAMERA ANGLE CAN'T BACK UP YOUR STORY!!
